1. OVERVIEW

Andaz Singapore%u2019s %u201CAuthentically Local Promotion%u201D (the %u201CPromotion%u201D) is operated and sponsored by Ophir-Rochor Hotel Pte Ltd trading as Andaz Singapore (%u201CSponsor%u201D or the %u201CCompany%u201D), 5 Fraser Street, Singapore 189354. The Promotion participation period begins at 00:01:00am Singapore Time (%u201CSGT%u201D) on October 2, 2023, and ends at 23:59:00 SGT on December 31, 2023 (the %u201CPromotion Period%u201D). You may enter the Promotion by following all instructions as more fully described in the %u201CHow to Enter%u201D section below and complying with all of the details in these Official Rules. Following the conclusion of the Promotion Period, participants who scan the most Codes (defined below) during the Promotion Period will be the potential winners as set forth in more detail in the Winner Selection Section below. By taking any step to participate in this Promotion, you fully and unconditionally agree to and accept these Official Rules and the decisions of Sponsor (each, an %u201CEntrant%u201D or %u201Cyou%u201D).

2. ELIGIBILITY

This Promotion is open only to individuals who are, at all times during Promotion participation, physically located in Singapore and, at all times during Promotion Participation and through the time of prize award: (a) are at least eighteen (18) years of age or older and the age of majority in their jurisdiction of residence, and (b) are NOT domiciled in and are NOT residents or citizens of Crimea, Donetsk, and Luhansk regions of Ukraine, Cuba, North Korea, Iran, or Syria, or any country or jurisdiction that is the target of U.S., Singapore, or United Nations trade or economic sanctions (as such list may be amended) or where the laws of the United States, Singapore, or local law prohibits their participation or receiving a prize in this Promotion (the "Territory"). You are not eligible to participate in the Promotion if you reside in any jurisdiction where all or any portion of this Promotion, including participation in the Promotion or receipt of any prize, may violate any law, rule, regulation, order, or employer policy applicable to you or any agreement to which you are a party. You are responsible for compliance with all laws applicable to participating. As a condition of participating in the Promotion, you agree that, if requested by Sponsor, you will provide documentation or other proof of your eligibility within the requested timeframe.

Sponsor has the absolute discretion at any time and from time to time to determine the eligibility of anyone to take part in the Promotion and will not be obliged to give any reason or basis for its decision.

Part-time or full-time staff, employees, officers, directors, members, managers, agents, and representatives of Sponsor and Hotel Project Systems Pte Ltd, and their respective corporate partners, parent companies, divisions, subsidiaries, affiliates, assigns, and successors in interest, each of their respective auditors, advertising agencies, promotion and public-relation agencies and any other persons involved (directly or indirectly) in designing, organizing, promoting, or fulfilling of the Promotion, (collectively, the %u201CReleased Parties%u201D) and the immediate families (defined for these purposes as any spouse, partner, parent, legal guardian, child, legal ward, sibling, grandparent, or grandchild and each of their respective spouses) and individuals living in the same household as such persons (whether or not related) are not eligible to participate or win the prize in this Promotion.

Promotion participation is void outside of Singapore and where prohibited by law.

3. HOW TO ENTER

To enter, eligible individuals must follow the on-screen instructions to provide all required information to create an account at the dedicated Promotion website located at www.sgstoryhunt.com (%u201CPromotion Website%u201D) within the Promotion Period. After creating an account on the Promotion Website, Entrants can participate in the Promotion by visiting the various locations listed on the Promotion Website and scanning the code physically located at the location (each, a %u201CCode%u201D) with their smartphone. Entrants are responsible for having connectivity to the internet to record Code scans and are responsible for all charges incurred by their mobile carrier. Entrants must be logged into their account at the time the Code is scanned for the scan to count towards Promotion participation. Each Code may be scanned one (1) time per participant during the Promotion Period. Entrants may only participate from one Promotion Website account. Any attempt to participate in excess of this limit by any means, including, without limitation, by creating more than one Promotion Website account, will be void, all of the Entrant%u2019s Promotion participation may be disqualified and any Code scans of any Code reproduction, e.g. a photo depicting the Code at a Promotion location, are prohibited and void. If an Entrant is found to be scanning Code reproductions, Entrant may be disqualified from the Promotion in Sponsor%u2019s sole discretion and the. prize won may be forfeited in the Sponsor%u2019s sole discretion.

Each Entrant will be eligible to win only ONE (1) Prize.

Sponsor%u2019s clock will be the official timekeeper for this Promotion. All participation, including all Codes scanned, must be received and recorded by Sponsor during the Promotion Period in strict accordance with the instructions and restrictions in these Official Rules. Participation that is not timely recorded by Sponsor will not be counted towards Promotion participation. For purposes of this Promotion, participation is %u201Crecorded%u201D when the applicable Code scan is logged through the Promotion Website. Other proof of scanning or attempting to scan a Code (such as, without limitation, a %u201CThanks for visiting%u201D message following a Code scan) does not constitute proof of actual recordation of a Code for purposes of this Promotion.

As a condition of participation in the Promotion, without limiting any other provision in these Official Rules, each Entrant gives consent for Sponsor and its agents to obtain and deliver their name, address, and other information and content to third parties for the purpose of administering this Promotion and complying with applicable laws, regulations, and rules.

For the avoidance of doubt, Sponsor will not be responsible or liable (a) for any Code scans that fail to be recorded by Sponsor for any reason whatsoever or for any failure, technical error or delay in the transmission of a Code scan to Sponsor for any reason whatsoever before the expiry of the Promotion Period; (b) for any failed, incomplete, distorted, undelivered, late, damaged, illegible or Promotion participation; or (c) for any breakdown or malfunction in any computer system or equipment or network connection or internet connection, which may result in the Entrant being omitted from taking part in the Promotion or for any claim or cause of action arising out of or in connection with the Promotion. No appeal, correspondence, or claims for payment of compensation will be considered or granted.

4. WINNER SELECTION

Following the end of the Promotion Period,

the four (4) Entrants with highest recorded number of Code scans through the Promotion Website will be deemed %u201CWinners,%u201D subject to verification, and may be required to read, agree to, and sign documentation confirming their agreement to these Rules (including a liability release and grant of rights) as a condition of proceeding in the Promotion, otherwise they will be disqualified. If any potential Winner is disqualified, Sponsor will determine and notify the next runner-up, time permitting. In the event two or more Entrants scanned the same number of Codes during the Promotion Period, the tie will be broken by a random drawing among all tied Entrants. Winner determination and any tie breaker drawing will occur on January 3, 2024 at the Andaz Singapore at approximately 14:00:01. Odds of winning a prize in the event of a tie depend on the number of tied Entrants.

Sponsor reserves the right to contact Entrants for verification purposes and administration of the Promotion. Sponsor%u2019s decisions are final and binding in all matters relating to this Promotion.

5. WINNER NOTIFICATION

There will be a total of four (4) Winners.

The Winners will be contacted within approximately five (5) business days of the end of the Promotion Period. All Winners will be contacted via the email address used to create their Promotion Website account, and they are required to respond according to Sponsor%u2019s instructions in the notification within seven (7) days including providing a signed prize release in the form provided by Sponsor. Failure to do so will result in the forfeiture of the respective Prize.

Sponsor%u2019s decision of, and method of selecting, the Winner will be at its absolute discretion and will be final, conclusive, and binding. Sponsor will not be liable to any Entrant not being eligible to receive the Prize offered under the Promotion. No appeal, correspondence or claims or payment of compensation will be accepted.

Sponsor may provide Winners, via the email address the Winner provided with verification documents including a prize release. If Sponsor provides Winners with verification documents, the Winners must complete and return all documentation within seven (7) days of receipt, as well as send Sponsor a copy of their identity card, FIN, or passport. Sponsor may retain information provided as part of Promotion participation to the maximum extent allowed by applicable law.

Sponsor reserves the right to select alternate Winners to substitute any Winner who is subsequently found to be ineligible or disqualified or where the Winner is unable to furnish satisfactory proof that they are indeed the same person as the individual identified in the Promotion Website account and/or the owner of the email address used to create the Promotion Website account (for example, by showing all documentary evidence of proof of name and identification number etc.) associated with the winning participation. If a Winner cannot be confirmed or is otherwise ineligible to receive a Prize, Sponsor will not be obligated to pursue more than three (3) Winners for any Prize.

Sponsor may announce the Winners publicly, including, without limitation, on the Promotion Website, Sponsor%u2019s social media accounts and feeds, and elsewhere.

6. PRIZES (%u201CPRIZES%u201D) & APPROXIMATE RETAIL VALUE (%u201CARV%u201D)

The Prizes are each subject to their own set of terms and conditions. Redemption of the Prizes is subject to a fixed redemption period and availability. Prizes are provided "as is" without further representation, warranty or guarantee of any kind, express or implied. In the event any element of any prize becomes unavailable before it is both awarded and redeemed for any reason beyond the reasonable control of Sponsor, Sponsor will provide a substitute prize selected in its sole discretion. However, if after prize award, a Winner becomes unable to use or redeem any portion of their Prize, that Winner forfeits use of the prize and Sponsor will not be responsible for any payment or awarding any substitution.

GRAND PRIZE: One (1) Grand Prize Winner will be awarded one (1) prize consisting of a voucher for a three (3)- night stay in Andaz Singapore Two-Bedroom Suite inclusive of daily breakfast at Alley on 25 for two (2) persons. The prize is not eligible to redeem World of Hyatt points. Any additional expenses related to travel to the hotel, in room dining, restaurants or bar, spa or other onsite amenities and services are not included in the Grand Prize and are Grand Prize Winner%u2019s sole responsibility. ARV of the Grand Prize: SGD 5,130

FIRST RUNNER-UP PRIZE: One (1) First Runner-Up will be awarded one (1) voucher for Set Dinner for two (2) persons at 5 ON 25. ARV: SGD 494.21

SECOND RUNNER-UP PRIZE: One (1) Second Runner-Up will be awarded one (1) voucher for Set Dinner for two (2) persons at 665F. ARV: SGD 351.65

THIRD RUNNER-UP PRIZE: One (1) Third Runner-Up will be awarded one (1) voucher for two (2) cocktails of choice and one (1) Chef%u2019s Platter at Mr. Stork. ARV: SGD 135.00

Total ARV of all Prizes: SGD 6110.86. Vouchers are valid until 30th June 2024. There is no extension of a Voucher after the expiry date. Voucher must be presented by providing the unique code associated with the Voucher at the time of redemption for it to be applied. Advance booking at https://www.hyatt.com/andaz/sinaz-andaz-singapore is required and subject to availability at point of booking. A Voucher is not an eligible payment method allowing World of Hyatt members to earn Base Points for Tier-Qualifying Night credits for hotel accommodation. A Voucher is not valid on eve of and on Public Holidays (%u201CBlackout Dates%u201D). Sponsor reserves the right of final decision in case of any dispute arising from use of a Voucher and the right to request alternative forms of payment if a Voucher is fraudulently obtained or used. A Voucher is not returnable, refundable, or redeemable for cash, and may not be resold or transferred for value. A Voucher expires as set forth above. There will be no refund or credit for unused portions. A Voucher transferred fraudulently, unlawfully, or otherwise in violation of these terms, is subject to cancellation. Sponsor reserves the right to institute additional security and verification procedures at the time of Voucher redemption for fraud prevention.

The following applies to all Prizes and Winners:

No prize substitution or exchange will be allowed. The Winner will be solely responsible for payment of any and all applicable federal, state, provincial, territorial, and local taxes. If a potential Winner is disqualified, found to be ineligible, declines to accept a prize or, if Sponsor is unable to contact the Winner, or a Promotion-related communication or a prize or communication is returned undeliverable, the Prize may be forfeited and awarded to an alternate winner. A Winner may be required to furnish proof of identification at Sponsor%u2019s sole discretion. Sponsor is not responsible for Winner%u2019s privacy or spam filter settings, which may divert any Promotion-related message or e-mail, including any notification, to a spam or junk folder.

Sponsor may, at any time and from time to time in its sole and absolute discretion and without prior notice or assigning any reason thereof or assuming any liability or payment of compensation to any person, substitute, replace or change the Prizes stipulated in these Rules, with another prize of similar value (whether in cash or otherwise). Sponsor%u2019s determination of the substituted prize will be final, conclusive and binding. No appeal, correspondence or claims will be accepted.

Winners agree not to use prizes in any way, directly or indirectly, that would violate applicable laws, including, without limitation, in any manner that would constitute bribery, an illegal kickback, an illegal campaign contribution, or any other violation of applicable anti-corruption, political activity, economic sanctions, or other laws.

7. LICENSE RIGHTS GRANTED BY ENTRANTS

By participating in the Promotion, to the maximum extent permitted by applicable law, every Entrant and each Winner expressly and irrevocably grants the Released Parties the irrevocable, sublicensable, absolute right and permission to use, publish, post or display their name, photograph, likeness, voice, prize information, biographical information, any quotes attributable to them and any other indicia of persona (regardless of whether altered, changed, modified, edited, used alone, or used with other material in the Released Parties%u2019 sole discretion) for advertising, trade, promotional and publicity purposes without further obligation or compensation of any kind to them, anywhere, in any medium now known or hereafter discovered or devised (including, without limitation, on the Internet), worldwide, without any limitation of time, and without notice, review, or approval and each Entrant releases all Released Parties and their licensees from any and all liability related thereto. Nothing contained in these Official Rules obligates Sponsor to make use of any of the rights granted in these Rules and Entrant waives any right to inspect or approve any such use.

By entering the Promotion, each Entrant agrees to co-operate and participate in any advertising, promotional and publicity and/or commercial activities organized by Sponsor in relation to the Promotion and consents and authorizes Sponsor to use and disclose any data provided by the Entrants for any future marketing effort by Sponsor.

8. LIMITATION OF LIABILITY

NOTHING IN THESE OFFICIAL RULES LIMITS, EXCLUDES, OR MODIFIES OR PURPORTS TO LIMIT, EXCLUDE, OR MODIFY ANY STATUTORY CONSUMER GUARANTEE OR ANY IMPLIED CONDITION OR WARRANTY, THE EXCLUSION OF WHICH FROM THESE OFFICIAL RULES WOULD CONTRAVENE ANY STATUTE OR CAUSE ANY PART OF THESE OFFICIAL RULES TO BE VOID (%u201CNON-EXCLUDABLE GUARANTEES%u201D). SUBJECT TO THE LIMITATIONS IN THE PRECEDING SENTENCE AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EACH ENTRANT AGREES TO RELEASE, DISCHARGE, HOLD HARMLESS, AND INDEMNIFY EACH OF THE RELEASED PARTIES FROM AND AGAINST ANY CLAIMS, DAMAGES, DISABILITIES, ATTORNEYS' FEES, AND COSTS OF LITIGATION AND SETTLEMENT, AS WELL AS ANY LIABILITY WHATSOEVER, FOR INJURIES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH: (i) THE PROMOTION; (ii) THE USE, ACCEPTANCE, POSSESSION, MISUSE OR AWARDING OF THE PRIZE; OR (iii) WHILE PREPARING FOR, PARTICIPATING IN, AND/OR TRAVELING TO OR FROM ANY PROMOTION-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, OR ACCIDENT TO/OF PERSON OR PROPERTY.

9. DISPUTES / GOVERNING LAW

Except where prohibited by law, any and all disputes, claims, and causes of action between an Entrant and any Released Party arising out of or connected with this Promotion or these Official Rules must be resolved individually, without resort to any form of class action or legal action on behalf of any group. Further, in any such dispute, under no circumstances will an Entrant be permitted or entitled to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys%u2019 fees, other than the Entrant%u2019s actual out-of-pocket expenses (if any), not to exceed ten dollars ($10) and each Entrant further waives all rights to have damages multiplied or increased.

The Promotion (whether for breach of contract, tortious conduct, or otherwise) will be governed by the laws of Singapore, without giving effect to its conflicts of law or choice of law principles or rules that would cause the application of the laws of any other jurisdiction. Any legal actions, suits or proceedings related to this Promotion (whether for breach of contract, tortious conduct, or otherwise) will be brought exclusively in the Singapore Courts, and each Entrant will be deemed to have irrevocably agreed to submit to the exclusive jurisdiction of the Singapore Courts with respect to any legal actions, suits or proceedings arising out of or related to this Promotion.

These Official Rules will be in English only, which language will prevail, govern, and control in all aspects, and all translated versions of these Official Rules in any other language will be for reference only and will not be binding. In the event of any discrepancy or inconsistency between the English version and any translated version, the English version will prevail.

10. ADDITIONAL DISCLAIMERS

The Released Parties are not responsible and/or liable for any of the following, whether caused by a Released Party, the entrant, or by human error: participation that occurs by illegitimate means (such as, without limitation, by an automated computer program or by scanning reproduction of Codes outside of the locations identified on the Promotion Website) or Code scans or other participation in excess of any stated limit; any lost, late, incomplete, illegible, unintelligible, garbled, mutilated, or misdirected scans or other participation, email, mail, or Promotion-related correspondence or materials or postage-due mail; any error, omission, interruption, defect or delay in transmission, votes or communication; viruses or technical or mechanical malfunctions; interrupted or unavailable cable or satellite systems; errors, typos, or misprints in these Official Rules, any Promotion-related advertisements, or other materials; failures of electronic equipment, computer hardware, or software; lost or unavailable network connections or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications or participation information. Released Parties are not responsible for electronic communications that are undeliverable or do not reach entrant as a result of any form of active or passive filtering of any kind or insufficient space in a potential winner%u2019s email or voicemail inbox. Released Parties are not responsible, and may disqualify an entrant, if the entrant%u2019s email address or other contact information does not work or is changed without prior written notice to Sponsor. Without limiting any other provision in these Official Rules, the Released Parties are not responsible or liable to any entrant or winner (or any person claiming through such entrant or winner) for failure to supply the prize or any part thereof in the event that any of the Promotion activities or Released Parties%u2019 operations or activities are affected by any cause or event beyond the sole and reasonable control of the applicable Released Party (as determined by Sponsor in its sole discretion), including, without limitation, by reason of any acts of God, equipment failure, threatened or actual terrorist acts, air raid, act of public enemy, war (declared or undeclared), civil disturbance, insurrection, riot, epidemic, fire, explosion, earthquake, flood, hurricane, unusually severe weather, blackout, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, any law, rule, regulation, action, order, or request adopted, taken, or made by any governmental or quasi-governmental entity (whether or not such governmental act proves to be invalid), or any other cause, whether or not specifically mentioned above.

11. GENERAL RULES

Sponsor%u2019s decisions will be final in all matters relating to this Promotion, including interpretation of these Official Rules, selection of the winner, and awarding of the Prizes. All participants, as a condition of participatoin, agree to be bound by these Official Rules and the decisions of Sponsor. Participants further agree to not damage or cause interruption of the Promotion and/or prevent others from participating in or engaging with the Promotion. Sponsor reserves the right to restrict or void participation from any IP address or Promotion Website account if any suspicious participation is detected. Sponsor reserves the right, in its sole discretion, to void the participation of any Entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Promotion. Sponsor%u2019s failure or decision not to enforce any provision in these Official Rules will not constitute a waiver of that or any other provision. In the event there is an alleged or actual ambiguity, discrepancy, or inconsistency between disclosures or other statements contained in any Promotion-related materials and/or these Official Rules (including any alleged ambiguity, discrepancy, or inconsistency within these Official Rules), it will be resolved by Sponsor in its sole discretion. Entrants waive any right to claim ambiguity in the Promotion or these Official Rules. If Sponsor determines at any time in its sole discretion that a winner or potential winner is disqualified, ineligible, in violation of these Official Rules, or engaging in behavior that Sponsor deems obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, or harass any other person, Sponsor reserves the right to disqualify that winner or potential winner, even if the disqualified winner or potential winner may have been notified or displayed or announced anywhere. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules will otherwise remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained in these Rules. If the Promotion is not capable of running as planned for any reason, Sponsor reserves the right, in its sole discretion, to cancel, modify, or suspend the Promotion and award the prize from eligible participation recorded prior to cancellation, modification, or suspension or as otherwise deemed fair and appropriate by Sponsor. If any person supplies false information, participates by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain a prize, Sponsor may disqualify that person and seek damages from them and that person may be prosecuted to the full extent of the law. In the event of a dispute concerning the identity of an entrant, the entrant will be declared to be the registered account holder of the email address associated with the Promotion Website account through which Promotion participation occurred, but only if that person meets all other eligibility criteria, otherwise the participation may, in Sponsor%u2019s sole discretion, be disqualified and any potential prize won will be forfeited. A registered account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the applicable email address. The potential winner may be required to provide Sponsor with proof that he or she is the registered account holder of the email address from which the potentially winning participation was recorded. If a dispute cannot be resolved to Sponsor%u2019s satisfaction, the participation will be deemed ineligible. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE PROMOTION VIOLATES CRIMINAL AND CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANT MAKING SUCH ATTEMPT AND MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

While all information provided in these Rules is believed to be correct and reliable at the time of publishing or posting online, Sponsor makes no representation or warranty whether express or implied, and accepts no responsibility or reliability for its completeness or accuracy. In the event of any inconsistency between these Official Rules and any advertising, promotional, publicity and other materials relating to or in connection with the Promotion, these Official Rules will prevail.

These Official Rules will be in English only, which language will prevail, govern and control in all aspects, and all translated versions of these Official rules in any other language will be for reference only and will not be binding. In the event of any discrepancy or inconsistency between the English version and any translated version, the English version will prevail.

In the event of any discrepancy or inconsistency between the Official rules and disclosures or other statements contained in any Promotion-related materials, the Official Rules will prevail, govern, and control.

12. PRIVACY POLICY

Sponsor may collect personal data about Entrants in accordance with the hotel%u2019s privacy policy and the personal information collection statement. Please review that privacy policy here, including cookies policy and personal information collection statement. By entering the Promotion, Entrants agree to the collection and usage of personal data and acknowledge that they have read and accepted the that privacy policy and the personal information collection statement.

13. WINNER%u2019S LIST / OFFICIAL RULES

A copy of these Official Rules is available during the Promotion Period at the Promotion Website or upon request by emailing getsocial.sg@andaz.com with the subject line %u201CRequest for Promotion Rules%u201D. Rules requests must be received before the end of the Voting Period. For information about who won, send an email to getsocial.sg@andaz.com with the subject line %u201CRequest for Promotion Results%u201D. Requests for winner information must be received no later than three (3) months after the end of the Voting Period.
